Our Terms of Services
These Terms of Service (“Terms”) govern your access to and use of TruPilot software applications and related services (collectively, the “Service”) provided by [Your legal entity name], a [entity type, e.g., corporation] with its principal place of business at [address] (“we,” “us,” or “our”).
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
We may update these Terms from time to time. We will post the updated Terms and update the “Last updated” date above. If changes are material, we will provide additional notice as required by law or as we reasonably deem appropriate. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms, except where applicable law requires your express consent.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You may not use the Service if you are barred from doing so under applicable law or if we have previously terminated your account for breach of these Terms.
2. The Service
TruPilot provides AI-assisted writing and prompt-related tools, including features that may be offered through our iOS application, iOS keyboard extension, macOS application, and related online services (such as APIs and cloud sync) that we operate or enable.
The Service relies on third-party infrastructure and AI providers. Outputs are generated using automated systems and may be incorrect, incomplete, or unsuitable for your purpose. See Section 8 (Disclaimers).
We may modify, suspend, or discontinue features, impose limits, or introduce new features. We will try to provide reasonable notice of material adverse changes where practicable, but we do not guarantee uninterrupted or error-free operation.
3. Accounts and security
Certain features require an account. You agree to:
Provide accurate registration information and keep it current.
Maintain the confidentiality of your credentials and restrict access to your devices.
Notify us promptly at support@trupilot.co if you suspect unauthorised access.
You are responsible for activity under your account except where our systems are compromised through no fault of yours.
We may suspend or terminate accounts that violate these Terms, pose security risk, or as required by law.
4. Subscriptions, purchases, and billing
Paid features may be offered via in-app purchases processed by Apple (or other authorised platforms). Payment processing, renewal, cancellation, and refunds for purchases through Apple are governed by Apple’s applicable terms and policies, except where mandatory consumer laws provide otherwise.
Recurring subscriptions renew automatically until canceled in accordance with platform rules (for example, through your Apple ID subscription settings).
Prices and taxes are as displayed at checkout and may change with notice as required by law or platform rules.
Free trials and promotions (if offered) are subject to the terms shown at the time of offer.
If you use third-party subscription or paywall tooling (for example, partners that present purchase flows), your relationship with those partners is also subject to their terms and privacy notices, in addition to ours.
To the maximum extent permitted by law, we do not guarantee that any particular feature will remain available in any specific pricing tier.
5. License to use the Service
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for your personal or internal business purposes, in accordance with the documentation and applicable app store rules.
You will not (and will not permit others to):
Copy, modify, distribute, sell, lease, or reverse engineer the Service except as permitted by law;
Circumvent technical measures, rate limits, or access controls;
Use the Service to develop a competing product or to benchmark or scrape our systems in violation of our policies or applicable law;
Remove or alter proprietary notices;
Use the Service in violation of Section 7 (Acceptable use).
Open-source and third-party components included in the Service are subject to their respective licenses where applicable.
6. Your content and license to us
You may submit text, prompts, context, templates, and other materials (“User Content”) to the Service.
You retain ownership of your User Content, subject to the rights you grant below.
To operate the Service, you grant us a worldwide, non-exclusive license to host, store, reproduce, process, transmit, display, and create derivative works as reasonably necessary to provide and improve the Service (for example, formatting, enhancement, synchronisation across your devices, security monitoring, and troubleshooting). This license ends when you delete the User Content or your account, except (a) where we retain copies as described in our Privacy Policy or as required by law, and (b) reasonable time needed to remove data from backups and replicated systems.
You represent and warrant that you have all rights necessary to grant the above license and that your User Content does not violate Section 7 or third-party rights.
Do not submit information you are not allowed to share (for example, third-party confidential data, regulated health data you are not permitted to upload, or content you do not have rights to use).
7. Acceptable use
You agree not to use the Service to:
Violate any law or regulation, or infringe intellectual property, privacy, or other rights;
Generate, solicit, or distribute illegal, fraudulent, harmful, harassing, hateful, violent, or sexually exploitative content, or content intended to deceive others;
Attempt to obtain unauthorised access to our systems, other users’ accounts, or third-party systems;
Interfere with or disrupt the Service or our vendors;
Use the Service in high-risk scenarios where failure could lead to death, serious injury, or environmental harm (for example, operating critical infrastructure, medical devices, or autonomous vehicles), unless you implement appropriate human oversight and safeguards and comply with all applicable regulations.
We may investigate misuse and cooperate with law enforcement as permitted by law.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
AI OUTPUTS. The Service may produce automated suggestions and outputs. You are solely responsible for evaluating outputs for accuracy, appropriateness, and legality before relying on them. Outputs are not professional advice (including legal, medical, financial, or other professional advice). You should consult qualified professionals where appropriate.
NO GUARANTEE OF RESULTS. We do not warrant specific business, academic, or personal outcomes from use of the Service.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, our warranties are limited to the fullest extent permitted.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU HAVE NOT PAID US.
These limitations do not apply where prohibited by law (for example, liability for gross negligence, willful misconduct, or death or personal injury caused by negligence in jurisdictions that do not permit such exclusions).
10. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Service in violation of these Terms or law; or (c) your violation of third-party rights.
11. Third-party services
The Service may integrate with or link to third-party services (for example, authentication, cloud hosting, analytics, subscription tooling, and AI model providers). Those services are governed by their terms and privacy policies. We are not responsible for third-party services.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy available at trupilot.co/privacy. By using the Service, you acknowledge that we process information as described there.
13. Intellectual property
The Service, including software, branding, logos, and documentation (excluding your User Content), is owned by us or our licensors and protected by intellectual property laws. Except for the limited license in Section 5, no rights are granted to you.
Feedback you voluntarily provide may be used by us without obligation to you, except where prohibited by law.
14. Termination
You may stop using the Service at any time and may delete your account where the Service offers that capability.
We may suspend or terminate your access if you materially breach these Terms, if we must comply with law, or if we cease offering the Service (with notice where reasonable).
Upon termination, Section 5 (license) ends. Provisions that by their nature should survive (including Sections 6, 8–11, 13, 15–18) survive termination.
15. Export and sanctions
You represent that you are not located in a country subject to comprehensive U.S. sanctions or listed on any U.S. government restricted-party list. You will comply with applicable export control and sanctions laws.
16. Governing law and disputes
These Terms are governed by the laws of [State/Country], excluding conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply.
Venue. Subject to mandatory laws, exclusive jurisdiction and venue for disputes will be the courts located in [city, state/country], except that either party may seek injunctive relief in any court of competent jurisdiction.
Informal resolution. Before filing a claim, you agree to contact us at support@trupilot.co to try to resolve the dispute informally.
Class action waiver. To the maximum extent permitted by law, disputes must be brought only on an individual basis, not as a plaintiff or class member in any class or representative proceeding.
If you are a consumer in the EEA or UK, mandatory consumer rights and local dispute resolution rules may apply instead of portions of this section where required by law.
17. Apple-specific terms (iOS / macOS App Store)
If you obtained the Service through the Apple App Store, you acknowledge that:
These Terms are between you and Rene Niskanen, not Apple.
Apple has no obligation to provide support for the Service.
In the event of a failure to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price subject to Apple’s policies; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
Apple is not responsible for addressing claims relating to the Service, including product liability claims, regulatory compliance failures, or consumer protection claims.
If a third party claims the Service infringes intellectual property rights, Rene Niskanen (not Apple) is responsible for investigation, defence, settlement, and discharge of such claims, as required by these Terms and applicable law.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you.
You must also comply with Apple’s applicable App Store Terms of Service.
18. Miscellaneous
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede prior understandings.
Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign without our consent.
Severability. If any provision is invalid, the remainder remains in effect.
No waiver. Failure to enforce a provision is not a waiver.
Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
